I recently had a customer who had little to no family and was extremely concerned that her wishes regarding life-sustaining procedures would not be honored.

Many of you may recall the years long legal battle surrounding the Terri Schiavo case. Schiavo’s husband was arguing with her parents about whether she should be taken off life support. In the time since this case, there have been several other cases around the country that involve conflicting beliefs of family members about the final wishes of their loved one during their incapacitation.

With the assistance of the Louisiana Secretary of State’s office, I was able to give our customer a newfound peace of mind and instant assurance that her wishes will be recognized.

How it Works 

What good is your Living Will, Burial Instructions or a Last Will and Testament if no one knows they exist after your passing or during your incapacitation?

Louisiana has made it easier for you to make your final wishes known by creating an electronic database that can be accessed by family, friends, medical staff and funeral homes.

Upon completion of your new documents, I can complete the registration process at the Louisiana Secretary of State’s Office for you.

When a new “Living Will” declaration is filed, a laminated wallet ID card and an engraved “Do Not Resuscitate” bracelet are provided to the declarant, indicating that the “Living Will” declaration is on file in our office.

When a new Last Will and Testament is registered, the information is strictly confidential until your death, at which time a copy of this information is provided to any person who presents a death certificate. This information includes the location of a Will – it does not register an actual copy of the Will.

The Secretary of State’s office does not provide blank forms for your Last Will and Testament. They also do not provide Living Will Declarations relating to a Specific Medical Procedure. However, I or one of our other Louisiana Notaries would be happy to assist you in crafting your Last Will and Testament and Living Will Declarations, as well as provide you with more information and register your new documents with Louisiana’s End of Life Registry service.
